Exemption for Concussion and Physical Injuries

While Jumbo Acosta Club involves minimal contact and the risk of concussions and accidents in our classes is low, we ask that you read and acknowledge that you understand our concussion and safety risk policy below.

What is a concussion?

A concussion is a type of traumatic brain injury, or TBI, caused by a blow, bump, or jolt to the head or by a hit to the body that causes the head and brain to move rapidly back and forth. This sudden movement can cause the brain to bounce or twist inside the skull, creating chemical changes in the brain and sometimes stretching and damaging brain cells.

The CDC estimates that up to 3.8 million concussions occur annually in the US through sports and recreational activities.

  • Concussions can occur without loss of consciousness.
  • Concussions can occur in any sport.
  • Proper recognition and management of concussions when they first occur can help prevent further injury or even death.

Recognizing a Possible Concussion


To help recognize a concussion, you should be attentive to the following two things among your athletes:
A blow, bump, or jolt to the head or body that results in a rapid movement of the head.
Any change in the athlete’s social or emotional behavior, thinking or memory, physical functioning, or sleep. You may notice the signs before the athlete does.

Recognize the signs and symptoms!

    • Dizziness or balance problems
    • Feeling tired, lacking energy.
    • Headaches
    • Nausea or vomiting (at first)
    • Vision problems
  • THINKING OR REMEMBERING
    • Attention or concentration problems.
    • Feeling slowed down
    • Foggy or groggy
    • Memory problems (short or long-term)
    • Trouble thinking clearly
  • SOCIAL OR EMOTIONAL
    • Anxiety or nervousness
    • Irritability or easy anger
    • Feeling more emotional
      Sadness
  • SLEEPING
    • Sleeping less than usual
    • Sleeping more than usual
    • Trouble falling asleep

Jumbo Acosta Club Policy “When in doubt, request to remove the athlete from class and seat them in a safe place.”

An athlete suspected of having a concussion or head injury will be immediately removed from the class or physical activity being performed and will not be allowed to return to class without written authorization from an authorized physician. Coaches should not leave the athlete alone, and the parent/guardian will be notified to follow up accordingly.

COVID-19 Liability Waiver

  • I agree and acknowledge the following:
  • I accept and acknowledge that my child’s participation in Jumbo Acosta Club activities may involve inherent risks, including, among others, the risk of exposure and/or illness resulting from the new coronavirus (“COVID-19”), and
  • I knowingly and voluntarily assume all of those risks and release JUMBO ACOSTA CLUB LLC and its coaches and leaders and the place where my child participates in skating classes from any liability.
  • My child is not experiencing any symptoms of illness, such as fever, cough, or difficulty breathing.
  • My child has not been diagnosed with COVID-19, and if my child has previously been diagnosed with COVID-19, my child has followed all medical recommendations after such diagnosis and has tested negative for COVID-19 since that time.
  • I do not believe that my child has been exposed to a person with a suspected or confirmed case of COVID-19 in the last 14 days.
  • If my child develops any symptoms of COVID-19, or if my child has a suspected or diagnosed case of COVID-19, I agree that my child will not attend or participate in any Jumbo Acosta Club activity.
  • I agree to immediately notify JUMBO ACOSTA CLUB LLC and its coaches if I believe my child has any symptoms of COVID-19 and/or if my child has a suspected or diagnosed case of COVID-19.
  • I will comply with all safety protocols that JUMBO ACOSTA CLUB LLC has implemented or will implement.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I ALSO UNDERSTAND THAT I HAVE WAIVED CERTAIN RIGHTS BY SIGNING IT, AS DESCRIBED ABOVE, WHICH I AGREE TO DO VOLUNTARILY.

Parental commitment


The implementation used in classes is one of the best ways to help athletes develop physically and emotionally in the sport of speed skating. Speed skating develops life skills, promotes a healthy lifestyle, and increases self-esteem.
That is why we ask you, as a parent with a strong influence on the experience of our children, youth, and adult athletes, to assume this commitment and help us ensure that they have an enjoyable experience under an environment of responsibility and respect.
JUMBO ACOSTA CLUB Parental commitment “I, as a parent or legal guardian of a JUMBO ACOSTA CLUB athlete, accept that the most important result of any class or training is for my child to feel happy, motivated, and to have fun in class in a responsible manner. My child needs my approval and support, regardless of what happens in class, training or event. I will refrain from using negative or derogatory language directed at coaches, board members, parents of other athletes, or people observing this sport. I will encourage my child and everyone else in class or training and let the coach be the coach. I will do everything possible to model the sports behavior I want my child to adopt and support the coach so that this is the best possible experience for my child.”
I will respectfully accept any suggestions or instructions the coach may give me regarding my child’s progress or in case I have behaved improperly, with the aim of having respectful, pleasant, and up-to-date communication about my child or my conduct.

Photo release


I understand that coaches, including myself and my child, in the functions of Jumbo Acosta Club may be included in photographs and/or videos (the “Photos”) taken by spectators, parents, coaches, Board of Directors, and/or professional photographers.
Accordingly, I grant JUMBO ACOSTA CLUB LLC (and its designees, if any) the right to use the Photos, as well as my name, my child’s name (only first name), and likeness, in any manner and without any compensation to me or my child. I waive any right to inspect or approve the final version of the Photos and/or any written material attached, such as a description of the corresponding Photo.
Examples of how Jumbo Acosta Club uses Photos include social media, email marketing, printed marketing materials, Jumbo Acosta Club website, signage, and other materials used to promote the Jumbo Acosta Club LLC brand.
I declare that I am a legal parent/guardian of my child, who is a participant, and agree that the grant and release explained above bind us and my child to all of its terms.
I have read this photo release and fully understand its terms. I also understand that I have waived certain rights by signing this release, as explained above, and agree to do so voluntarily.

Registration Agreement

As the parent/legal guardian of the athlete and on my own behalf, and in consideration of being allowed to participate in any way in events and activities related to JUMBO ACOSTA CLUB LLC, I agree to and understand the following:

  • All deposits and fees are non-refundable under any circumstances.
  • There are no guarantees about the complete execution of classes at the assigned location, due to weather issues or circumstances beyond Jumbo Acosta Club’s control.
  • I understand that Jumbo Acosta Club’s main objective is to provide my child and me with a space and a learning moment in the sport of speed skating. If Jumbo Acosta Club does not provide the experience as described when I registered, I will notify the manager of my concern in writing on the Jumbo Acosta Club page so that it can be resolved.
  • Furthermore, I understand that Jumbo Acosta Club will not reserve a place where it holds the class or training for any particular child during class or training hours or grant the space to any other sports club until all Jumbo Acosta Club parents have been notified through the communication channels established by JUMBO ACOSTA CLUB.
  • I will follow all rules, regulations, and statutes established by JUMBO ACOSTA CLUB LLC and its legal representatives.

I have read this registration agreement and fully understand its terms. I also understand that by signing it, I have waived certain rights, as described above, which I voluntarily agree to do.

HARASSMENT AND ABUSE:

Jumbo Acosta Club considers it a fundamental right of all individuals involved in its activities to be able to participate in a safe and respectful environment and firmly believes that the welfare of its athletes is paramount.

Jumbo Acosta Club recognizes its responsibilities in this regard and is committed to creating and supporting an environment and culture free from harassment and abuse. Behaviors and actions that constitute harassment and abuse will not be tolerated.

Athletes, management, and staff of Jumbo Acosta Club must respect and comply with the principles set forth in this Policy.

DEFINITION OF HARASSMENT AND ABUSE:

Jumbo Acosta Club rejects and sanctions all forms of harassment and abuse as a basic principle of integrity and, specifically, through the rules contained in its Code of Conduct and Code of Ethics.

Jumbo Acosta Club adopts the following definitions of forms of harassment and abuse:

  • Psychological abuse: means any unwanted act that includes confinement, isolation, verbal aggression, humiliation, intimidation, infantilization or any other treatment that may diminish the sense of identity, dignity and self-esteem.

  • Physical abuse: refers to any deliberate and unwanted act, such as punching, beating, kicking, biting, and burning, which causes physical injuries or traumas. Such act may also consist of forced or inappropriate physical activity (for example, inappropriate training loads when injured or in pain), forced consumption of alcohol, or forced doping practices.

  • Sexual harassment: any unwanted and unpleasant conduct of a sexual nature, whether verbal, non-verbal, or physical. Sexual harassment may take the form of sexual abuse.

  • Sexual abuse: any conduct of a sexual nature, whether non-contact, with contact or with penetration, in which consent is coerced/manipulated or not given or cannot be given.

  • Negligence: failure of a coach or other person with a duty of care to the athlete to provide a minimum level of care, which is causing harm, allowing harm to be caused, or creating an imminent danger of harm.

To be defined as harassment and/or abuse, a behavior may be based on any reason, including race, religion, ethnic origin, gender, sexual orientation, age, disability, socio-economic status, athletic ability, as well as any other reason that may be used to cause the incident.

It can be a one-time incident or a series of incidents and can be in person or through other means, including online.

Harassment and abuse are often the result of an abuse of authority, i.e., the misuse of a position of influence, power, or authority by an individual or entity against another person or group.

Most often, harassment and abuse are strongly connected and may be the result of one another or its consequence. Therefore, the two offenses are often committed with a single behavior.

Jumbo Acosta Club recognizes that it will have a good number of athletes and to provide specific protection, it commits to involving the parents of minors in its activities and thus maintaining the safety of the athletes.

Jumbo Acosta Club is committed to treating potential cases of harassment and abuse involving minors with due caution and making the entire process as fluid as possible, considering not only the sensitivity of the issue in general but also the participation of the people involved in this stage of their lives.

OBJECT OF THE POLICY

This Policy aims to prevent harassment and abuse, create awareness, and provide clarity on what constitutes harassment and abuse, as well as establishing the process for reporting incidents and managing cases.

The objective of this Policy is to prevent harassment and abuse, create awareness, and provide clarity on what constitutes harassment and abuse, as well as establish the process for reporting incidents and managing cases.

POLICY SCOPE

This Policy applies to all individuals and entities (Participants) involved in the activities of Jumbo Acosta Club, such as:

a) Athletes;

b) Coaching staff (Coaches, Delegates. Often, harassment and abuse are strongly connected and can be the result or consequence of each other. Therefore, both infractions are often committed with a single conduct);

c) Jumbo Acosta Club Manager

d) Any other person participating in the activities of Jumbo Acosta Club, such as Organizing Committees, volunteers, event staff members, etc.

ROLES AND RESPONSIBILITIES

Jumbo Acosta Club will be responsible for implementing this Policy, communicating it to all individuals participating in its activities, and reporting any incidents of harassment and abuse that may occur. Whenever required by any applicable law, Jumbo Acosta Club will inform the competent authorities in case it is reported about abusive or harassing conduct that violates the law.

Jumbo Acosta Club will also ensure compliance with its own Rules and Regulations, as well as make sure that investigations are conducted according to the procedures included in its Statutes, Regulations, Codes, Rules, and Regulations, in order to impose appropriate disciplinary measures or corrective actions when there has been a violation of this Policy or any other Jumbo Acosta Club rule related to harassment or abuse.

Finally, Jumbo Acosta Club will make its best efforts to provide educational resources and training opportunities to all participants when required.

CONFIDENTIALITY

Any data and/or information shared with Jumbo Acosta Club, in relation to a possible case of abuse and/or harassment, will be treated confidentially and will not be disclosed except when required by applicable law or when the conduct in question may represent a possible criminal offense under any applicable law and has to be disclosed to the competent authorities.

APPROVAL AND EFFECTIVE DATE

This Policy has been reviewed by the Board of Directors of Jumbo Acosta Club and approved by them.

This Policy becomes effective on the day of its final approval by the Board of Directors of Jumbo Acosta Club.
